Couvert is a wedding gift list: couples put together wishes, and guests give money towards them online. These terms govern how couples and guests use Couvert. In case of discrepancies, the German version prevails.
1. Provider and scope
Couvert is operated by First name Last name, sole proprietorship, Street and number, Postcode Berlin, Germany ("Couvert", "we"). These terms apply to everyone who creates a list ("couple") or gives through a list ("guest"). Other terms do not apply.
2. What Couvert provides
Couvert gives couples a page for their gift list and passes guests' monetary gifts on to the couple. Couvert does not sell goods and owes no delivery. The wishes on a list describe what the couple would like the money for. A gift is an amount of money for the couple, who are free to decide how to use it.
3. Couvert's role and payment processing
Couvert acts as an intermediary in the name and on behalf of the couple. The gift is a gift from the guest to the couple. Couvert only receives the service fee under section 6.
Payments are processed by Stripe Payments Europe, Limited, Dublin ("Stripe"). The money for a gift goes via Stripe to the couple's account; Couvert does not receive it itself.
4. Couples: account and list
Adults living in Switzerland with a Swiss bank account can create a list. The couple provides accurate details and keeps access to their sign-in email address private.
For payouts the couple opens an account with Stripe and accepts Stripe's terms (Stripe Connected Account Agreement). The couple authorises Couvert to pass the necessary details to Stripe and to receive information about payments and payouts from Stripe. Stripe verifies the couple's identity. Until the account is connected, the list does not accept gifts.
5. Couples: page content
The couple creates their own page and is responsible for its texts, images and wishes. Content must not infringe third-party rights or be illegal. Couvert may block or remove content that breaches these terms or the law, in whole or in part, and close a list in serious cases. We inform the couple and give reasons. Anyone can report illegal content to hallo@lecouvert.ch.
The couple may not use the list to collect money for purposes other than wedding gifts.
6. Costs and service fee
Couples pay no base fee, no subscription and nothing for setting up Couvert. At checkout, guests can cover a service fee of 5 % of the gift amount. This fee is Couvert's remuneration. The guest decides explicitly at checkout, with yes or no, whether to cover the fee. Nothing is pre-selected, and payment is only possible once the guest has chosen. The total is shown before payment.
If a guest does not cover the fee, Couvert deducts the payment processing costs of that gift from the amount for the couple (currently about 1.9 % + CHF 0.30 for TWINT and 2.9 % + CHF 0.30 for cards). Current rates are on the fees page.
For couples who create their list during the pilot, until pilot end date, the costs in this section are fixed until their wedding, even if Couvert changes its fee model later.
7. Guests: how a gift works
The guest chooses wishes or amounts, writes a message and pays on Stripe's payment page with TWINT, card or another offered method. TWINT allows at most CHF 5,000 per payment. The gift is made when the payment is completed. The guest receives a confirmation by email; the couple sees name, message and amount in their dashboard.
8. Payouts to the couple
Stripe pays gifts out in batches to the couple's bank account. The schedule follows the settings at Stripe, currently daily, weekly or after the wedding. Stripe may hold payouts while details are missing or under review.
The couple is responsible for whether and how gifts are taxed for them.
9. Withdrawal, refunds and chargebacks
A gift is completed once it is paid to the couple. Refunds are possible for payment errors (such as a gift paid twice), if a list is closed before payout, or if the couple agrees. In these cases we also refund the service fee. Requests to hallo@lecouvert.ch.
If a guest starts a chargeback with their bank although the gift was carried out correctly, Couvert may reclaim the amount from the couple or set it off against future gifts.
10. Availability
We aim to provide Couvert without interruption but cannot guarantee it. Where possible we announce maintenance in advance.
11. Liability
Couvert is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are only liable for breach of essential obligations that make using Couvert possible in the first place, limited to the typically foreseeable damage. Couvert is not liable for outages or errors at Stripe or banks unless Couvert is responsible for them.
12. Term and deletion
A couple can close their list at any time and have their account deleted. Gifts already paid will still be paid out. Couvert can terminate the user agreement with 30 days' notice, or without notice for good cause (such as misuse).
13. Changes to these terms
If these terms change, we inform couples with an active list by email at least 30 days in advance. For a gift, the version in force at the time of payment applies.
14. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory protective provisions of the country where they habitually reside remain unaffected. Place of jurisdiction for merchants is Berlin.
15. Final provisions
If any provision is invalid, the remaining provisions stay in effect.
